Sales conditions for direct individuals

Article 1: General Terms and Conditions
The present Terms and Conditions apply to individual reservations equal or lower (inferior) up to 5 rooms, booked at one time through www.timhotel.com or directly in the hotels
The guest agrees to respect and all the parties concerned, all the conditions within this document as well as legal requirements and regulations.
These conditions of sale are changeable at any time and Terms and Conditions will be applicable (in force) at the date when the reservation will be made.
These Terms and Conditions will prevail over all other general sales conditions, not expressly approved by the PANINVEST group, owner of the TIMHOTEL brand.

Article 2: Ability
The guest must acknowledge that he is able to contract, that is to say he is of legal age or under guardianship.

Article 3: Reservation policy
Rates are in Euros, per room and per night, inclusive of taxes and services.
Rates are subject to change without notice. The price mentioned in the confirmation of the reservation is contractual.
Public rates : A credit card number is required to confirm your reservation. No change and cancellation are possible. Upon booking, the client accepts to be charged the full price of the stay, this amount being non refundable in case of cancellation or change of dates of stay. The hotel reserves the right to cancel your reservation if your bank does not authorise us to charge your credit card.

Article 4: Room availability
Rooms are at client's disposal from 14:00 on the day of arrival until 12:00 on the day of departure. Please contact the hotel in case of late arrival (after 6PM, local time).

Article 5: Cancellation Policy
Public rates :For all reservations book through www.timhotel.com, we kindly invite you to cancel your reservation through our 'modify or cancel a reservation' online system.
You can also cancel your reservation by contacting directly the hotel.
No penalty will be applied if your reservation is cancelled at least two days prior to the arrival date (before 6PM, Paris local time).
In case of late cancellation or no-show, the first night will be charged on the credit card. This time limit will be extended to seven days before the arrival date during Exhibitions and show events.
Bon Plan Tim, Last minute rates : Reservations can be neither cancelled nor modify. Full payment is required at the time of booking.
On application of this regulation of the article L.121-18 et L121-20-4 of the French consumer code, any right of retraction isn’t applicable to accommodation and/or food service which must be provided at a date or according to a determined period.

Article 6: Payment methods
The payment of all services will be made directly to the hotel on the day of departure. (except for Bon Plan Tim, Last minute rates and stay above 5 nights which are prepaid at the time of booking). The payment on the Website will be done by credit card and through a secure payment system.

Article 7: Out booking
In the case of absolute necessity or a major force (strike, war, etc..) exceptional events or technical problems in the hotel should make the guest’s stay impossible, the hotel will make every effort to find an alternative accommodation, if possible in a hotel of the same category or superior. The cost for transfer to another hotel (supplementary rate) will be paid by the hotel except in the case of a major force as detailed above.

Article 8: Computing and Liberty
The application of the French law 78-17, dicted ‘Informatique et Liberté’, the guests are warned that their reservation/name will be computer data processed. The user has the right, to access and modify the data recorded, with the headquarter of the company. It is stated that the information is not communicated to a third party.

Article 9: Complaints
All complaints must be sent by registered letter with return receipt to SAS PANINVEST – 60 rue Marcel Dassault 92100 Boulogne Billlancourt, France, no later than 15 days after the date of departure. Later than this period, the complaint cannot be considered.

Article 10: Insurance and Liability
The hotel declines all responsibility in cases of theft, loss, damage of property belonging to guest during their stay.
The guest will take responsibility for all damages, of all acts of vandalism which occur during the occupation of the premises and/or of personnel of which he is in charge, including furnishings the decoration and buildings belonging to or not to the hotel.
During the on line reservation process on our internet website we cannot take responsibility for any eventual damages such as resulting from the use of the internet network as loss of data, virus, break in service...

Article 11: Warning
The guest is advised not to invite any person whose behaviour is liable to cause harm to the establishment, the hotel reserves the right to intervene if necessary.

Article 12: Intellectual property
Concerning the use of the Internet website, the company PANINVEST is the patent holder of the rights and intellectual property relative to the website.
The accessible elements on the website, contained in the text, photographs, images, icon jingles, videos, software, databases, are equally protected by the industrial and intellectual property rights and other rights of privacy held by PANINVEST.
Without formal agreement, written by PANINVEST, it is expressly forbidden to reproduce, exploit, broadcast, use any heading / title for any reason even partially, the elements presented on website, or broadcast a simple hypertext link.

Article 13: Voidance partial
The voidance of a or several articles of the present general condition of sales do not result in the voidance of all contained herein,
The particular article which is totally or partially, seen as illegal, void, invalid or inapplicable, under the laws and rules in force, will be modified in the least measure possible allowing the present Terms and Conditions to be valid and applicable. All the other stipulations of these conditions will remain applicable and will be effective.

Article 14: Applicable Law
Litigation coming from the application or understanding of the current Terms and Conditions will be subject to French law and come under the exclusive competence of French justice, in the jurisdiction of the appeal court of Nanterre.
